RTSListings provides marketing, lead generation, homeowner introductions, and appointment-setting services for licensed real estate professionals. RTSListings is not a real estate brokerage and does not provide representation, listing services, or transaction management.
Client acknowledges that RTSListings provides marketing and homeowner introduction services only and does not guarantee listings, transactions, revenue, or business results.
Once a homeowner lead or transfer opportunity has been delivered, the service is considered rendered and cannot be returned. RTSListings’ system records — including timestamps, call logs, and recordings — constitute proof of delivery.
Client acknowledges that real estate transactions typically take 90–180 days or longer from initial contact to closing, with results depending on factors outside RTSListings’ control.
A valid lead meets the following standards:
Client acknowledges that homeowner intent may change and that expressed interest does not guarantee a transaction.
Replacement requests must be submitted within 48 hours of delivery. All determinations are made based on RTSListings’ call recordings and system records.
If the Client does not answer, rejects the call, routes to voicemail, or is otherwise unavailable, the transfer is considered successfully delivered and billable. RTSListings’ call logs constitute definitive proof of delivery.
Leads without completed live transfers may be offered at discounted rates and are not eligible for replacement credits.
Client authorizes RTSListings to charge for:
Existing clients will be notified of pricing changes in writing prior to implementation.
All payments are non-refundable. If RTSListings fails to deliver any transfers within 14 days of the agreed launch date, the platform fee may be refunded at RTSListings’ discretion.
RTSListings may suspend Services for failed or invalid payments.
Client must contact RTSListings before initiating chargebacks. Initiating a chargeback without first attempting resolution constitutes a breach of these Terms.
If a chargeback occurs, RTSListings may suspend Services and submit documentation — including agreements, call recordings, lead delivery records, and system logs — to payment processors.
All new clients agree to a minimum 30-day pilot period beginning from the date of their initial $19 zip code reservation payment. During this period:
After the 30-day pilot period, the service continues at $49/month to maintain reserved zip codes. Client may cancel at any time after the pilot period with no additional fees.
Results vary based on factors outside RTSListings’ control including market conditions, homeowner timing, client responsiveness, and follow-up practices.
Variations in conversion rates, appointments, or transactions do not constitute a failure of service, provided homeowner introductions meeting the Lead Quality Criteria are delivered.
Clients must:
RTSListings is not responsible for lost opportunities caused by delayed follow-up, missed calls, voicemail routing, call forwarding issues, scheduling conflicts, or client unavailability. Missed transfers remain valid and billable.
Client is responsible for compliance with all applicable laws including TCPA and Do-Not-Call regulations. RTSListings may use automated, AI-assisted, prerecorded, or technology-assisted communication systems in the delivery of its services.
Calls and communications may be recorded for quality control, compliance, and dispute resolution. RTSListings maintains records including timestamps, call logs, recordings, and system data which constitute official evidence of service delivery.
California clients acknowledge and consent to call recording under California Penal Code Section 632.
All RTSListings systems, scripts, materials, software, and data remain the exclusive property of RTSListings. Clients may not reproduce, distribute, or create derivative works without written permission.
RTSListings may suspend or terminate services for non-payment, suspected fraud, misuse of Services, violation of these Terms, or abusive behavior toward staff.
All new clients agree to a minimum 30-day pilot period. Cancellation before 30 days results in a $200 early cancellation fee.
Clients must complete the exit process within 14 days of cancellation. Failure to do so results in automatic termination and release of reserved zip codes to other agents.
Campaign pauses may be requested but are subject to approval. The monthly platform fee continues during approved pause periods unless stated otherwise in writing.
RTSListings’ total liability for any claim is limited to the amount paid by Client for the Services giving rise to the claim.
RTSListings shall not be liable for indirect or consequential damages including lost profits, missed commissions, or business losses.
Client agrees to indemnify and hold RTSListings harmless from any claims arising from Client’s use of the Services, homeowner contact, marketing practices, or violation of applicable laws.
These Terms are governed by the laws of the State of California.
Both parties agree to attempt good-faith negotiation for 30 days before initiating legal action. Unresolved disputes shall proceed to binding arbitration in California before a mutually agreed arbitrator.
By submitting payment or using Services, Client confirms:
RTSListings may update these Terms at any time. Clients will be notified of material changes at least 7 days before they take effect. Continued use of Services after changes take effect constitutes acceptance of updated Terms.
Any credits issued have no cash value, are non-transferable, and may be modified or discontinued at RTSListings’ discretion. Unused credits are forfeited upon cancellation.
